DEBT LAWSUIT OPTIONS IN VANCOUVER

IF YOU DO NOTHING

The company that sued you will likely obtain a default judgment against you. If this happens, the plaintiff may garnish your wages, empty your bank accounts and, if you own any real estate, attach a judgment lien to the property. Our experienced Vancouver debt defense attorney can help you avoid these outcomes.

Lawsuit filed with court
Lawsuit filed with court

Defendant served with paperwork

Days to file a written response or risk default judgment

After default judgment, the credit may garnish wages back accounts

The worst thing you can do is nothing and yet that’s what most people do. They don’t respond to the lawsuit and then a default judgment is filed against them. That gives the company that sued you the POWER to seize your bank accounts and garnish income.

This isn’t going to magically go away. The time to act is now. Not a week from now while you “think about it.” Checking out your bank balance only to find out that it has been emptied without any warning feels horrible. So does having paperwork sent to your work instructing your boss to start garnishing your wages. Contact our Vancouver debt defense attorney to understand what the debt collection process looks like.

Imagine losing twenty-five percent each paycheck until your debt, legal fees and costs are paid off with interest. You’ll have trouble paying the car payment, food, water bill…all the things you take for granted today. It doesn’t make you are real hero to your employer either. Even worse imagine checking your bank account balance and finding out that grocery money and rent is gone. The longer you wait, the worst it can get.

IF YOU WORK WITH A DEBT DEFENSE LAW FIRM

You DO have options! Because our firm handles collections lawsuits in Washington and Oregon, I can explain all of your options to get your finances under control and stop worrying about money. Together, you and I will review and select the option that will work best for you.

Some of our clients just want the lawsuit to go away, a reduced amount to pay back and a reasonable payment plan. We can help. Others have legitimate debt defenses that they need raised or they need to dispute the legitimacy of the debt itself. We can help. Others either need to file bankruptcy now or need some time before doing so in the future. Again, we can help.

You are not helpless. You have not failed. You may not be responsible for the situation you are in right now. But you ARE responsible for doing something about it. I’ll show you what to do and help you fix this mess! I’ll help you get your life back!

You need to know ALL your options before making ANY final decision. Contact our skilled Vancouver debt defense attorney to explore ALL the options available to you and compare the pros and cons of each. Start getting the right answer for you!

Frequently Asked Questions About Debt Lawsuit and Defense

How Much Does Debt Defense Cost?

Call Tom McAvity for a free phone appointment at 866-388-5106. I’ll review ALL of your debts and explain ALL of your options; then (and only then) will you be able to make the RIGHT choice. When we end this lawsuit – you will have your life back! The call is free, but the peace of mind you’ll have afterward is priceless. One call really CAN change it all!

Can a Creditor or Law Firm Sue Me for Debt?

All debt collection efforts are regulated by federal laws and the Fair Debt Collection Practices Act (FDCPA). This means that if your creditor intends to collect a debt on you, they have the legal capacity to appear in a courtroom to file a debt lawsuit against you. Worse, when they win, you may face a higher debt amount that includes their attorney fees for the lawsuit, plus other costs if the creditor can prove to the court that you really own the debt.

What Should I Do if I Get a Debt Lawsuit Notice?

The last thing you should do is ignore a debt lawsuit notice! Some debtors are overconfident that they do not owe debts, and decide to just toss the notice and forget about it until it’s too late. This is a big mistake! When these correspondences or letters from debt collection firms are ignored, they can ask the court to issue a default judgment in the case. When this happens, you lose the case automatically by virtue of not responding to the notices sent to you by your creditor.

What Is A Default Judgment?

When this judgment is issued, the debtor will be forced to repay the debt, have wages garnished by the debt collection agency or law firm, have a lien placed on valuable properties or your home, and have your accounts emptied.
